Birch Haven Rental is a quiet getaway in the heart
of northern Minnesota's finest lake country. We want you to safely
enjoy your stay, and we require your signature on the following
rental contract as part of your stay. A complete copy of
this agreement will be available for your signature upon arrival.
Check-in cannot be completed until this contract is signed.
This agreement made this ____ day of ________, 200__, between Roger
L. Hoyum, as Owner, and __________________________________, as Tenant(s)
(Additional parties listed on attached page) for the rental of the
premises, furnishings, and associated included equipment (hereafter
referred to as "Premises") located at , Grand Rapids, MN 55744 and
or the rental of personal property described on the attached Exhibit
A, hereinafter designated as equipment:
1. Term: Owner agrees to rent to Tenant said Premises for a term
beginning the ______ day of _________, 200__, and ending the ________
day of ____________, 200__, to be used and occupied for dwelling
purposes only, for _____ persons and no more;
2. Rent:
a. The Tenant shall pay rent, plus the non-refundable deposit ($________)
previously received by Owner, for said Premises as follows: $________/day;
$___________/____ days; or $________/ week;
b. The Tenant shall pay rent for such equipment as Tenant uses on
a daily basis pursuant to the attached Exhibit A (page 4), "A LA
CARTE RENTALS", which lists prices for equipment rental.
3. Use. Owner shall deliver or provide access to said Premises and
requested equipment to Tenant. Tenant shall use said Premises and
equipment according to attached Exhibit A and in a reasonable safe
manner at all times. Tenant shall comply fully with all the laws
of the State in which equipment is located and with all county or
municipal ordinances thereto likewise appertaining.
4. Damages. At the end of the term hereof Tenant shall leave said
Premises and return all equipment to Owner in as good condition
as exists at the commencement of said term, reasonable wear and
tear in respect thereto expected. The Premises and equipment shall
be subject to inspection by Owner. Tenant agrees to pay for any
damages to the Premises and or equipment based upon the actual costs
of cleaning and repair or if not repairable, the reasonable value
of replacement for the damaged items and equipment.
5. Repossession. If Tenant defaults in any of the rules, restrictions,
covenants, conditions or provisions of this agreement including
attached Exhibit A, it is agreed that Owner may immediately and
without notice take possession of the Premises and equipment wheresoever
found and to remove and keep or dispose of the same and any unpaid
rentals shall at once become due and payable. If any step is taken
by legal action or otherwise by Owner to recover possession of the
Premises or equipment or otherwise enforce this agreement or to
collect moneys due hereunder Tenant shall pay Owner the equivalent
of the moneys expended or charges incurred by Owner in such behalf,
including reasonable attorney's fees.
6. Indemnification. Tenant shall and does hereby agree to indemnify
and save Owner harmless from any and all liability, loss, damage,
expense, causes of action, suits, claims or judgments arising from
injury to Tenant, Tenant's guests and third parties or property
resulting from or based upon the actual or alleged use of said Premises
and operation of the equipment, including alleged imperfect or defective
equipment. Tenant shall, at its own cost and expense, defend any
and all suits which may be brought against Owner, either alone or
in conjunction with other upon any such liability or claim or claims
and shall satisfy, pay and discharge any and all judgments and fines
that may be recovered against Tenant in any such action or actions,
provided, however, that Owner shall give Tenant written notice of
any such claim or demand.
7. No Assignment. Neither this agreement nor any right or interest
thereunder shall be assigned by Tenant in any respect whatsoever.
8. Governing Law. This agreement shall be deemed to have been executed
and entered into the State of Minnesota and shall be construed,
enforced and performed in accordance with the laws thereof.
9. Entire Agreement. This instrument and the attached Exhibit A
contains all of the agreements of the parties. No verbal or other
statements, proposals or agreements shall be binding on either of
the parties hereto.
10. Acknowledgment. Tenant hereby acknowledges receipt of the attached
Exhibit A and that Tenant has read and understands the contents
of Exhibit A. In Witness Whereof, the parties have signed these
presents the day and year first above mentioned.
